1. Introduction
Welcome to Maghsala! These Terms and Conditions (“Terms”) govern your use of our services, including the website, mobile applications, and any other related services (collectively, the “Platform”). By using our Platform, you acknowledge and agree to these Terms. If you do not agree to these Terms, you must not use the Platform.
Maghsala is a digital platform that connects Users with laundry service Providers and facilitates the pickup and delivery of laundry services through our employed Drivers. These Terms outline the responsibilities and expectations for all parties involved.
2. Scope of Operations
• Maghsala is currently operating in Saudi Arabia, starting with Riyadh.
• The Platform intends to expand to other cities within Saudi Arabia and eventually to other countries.
• Maghsala strictly adheres to all applicable laws and regulations in Saudi Arabia, and all Users, Providers, and Drivers are expected to comply with these legal requirements.
• As Maghsala grows, it will ensure compliance with the local laws of any additional regions or countries it operates in.
3. Services
3.1. Role of Maghsala
• Maghsala acts as an intermediary platform connecting Users with third-party laundry service Providers.
• The Platform also facilitates pickup and delivery services through Drivers employed directly by Maghsala.
• While Maghsala verifies and onboards Providers to maintain quality standards, it does not guarantee or take responsibility for the quality of services provided by the Providers.
3.2. Order Placement
• Users are required to:
• Accurately select each item (e.g., shirts, pants) and specify the quantity during the order placement process.
• Ensure the information provided is correct to facilitate proper tracking and order management.
• The cost estimate is based on the items and quantities entered by the User.
• Any additional items handed over to the Driver that were not included in the order will incur extra charges.
• Maghsala and the Providers are not liable for any lost, misplaced, or damaged items not listed in the order. Proper item selection is crucial for effective service management.
3.3. Scheduling and Delivery
• Users must select a pickup date and time window (e.g., 5:30 PM to 6:00 PM).
• Delivery will occur approximately 24 hours later within the same selected time window.
• Future services, such as same-day premium delivery, may be introduced at a later time with proper notice.
• Users must:
• Be present at the designated pickup and delivery location during the selected time window.
• Respond promptly to Drivers for smooth service operation.
• Waiting charges may apply if the Driver is required to wait for more than 10-15 minutes at the location.
• If the User fails to hand over items during the scheduled pickup window, additional charges may apply.
3.4. Payments
• Cash on Delivery (COD):
• Users opting for COD must pay the full amount promptly at the time of delivery.
• Failure to pay will result in the deactivation of the User’s account. The account will remain inactive until all outstanding payments are cleared.
• Maghsala does not operate on a credit or “pay later” model.
• Pricing:
• Prices displayed on the Platform include a service fee charged by Maghsala, which may differ from local laundry prices.
• The price paid by the User includes this service fee and is not necessarily the amount paid to the Provider.
3.5. Provider Payments
• Providers will be paid in accordance with the agreement between Maghsala and the Provider.
• Payment schedules may vary and may be:
• Same-day payments after each delivery,
• Weekly payments, or
• Monthly payments.
• Providers agree to pay a commission fee to Maghsala for using the Platform. The commission will be deducted before payment is made to the Provider.
3.6. Drivers
• Drivers are employed directly by Maghsala and are paid on a payroll basis.
• Drivers are not entitled to any share of the commission paid by Providers.
• Maghsala is liable for any damages or losses occurring during the pickup or delivery process while items are in the possession of our Drivers.
3.7. Refund Policy
• Maghsala operates under a strict no-refund policy.
• Users are encouraged to carefully review their orders before confirming them on the Platform.
4. Liability
4.1. Maghsala’s Liability
• Maghsala is responsible for damages or losses only during the pickup and delivery process while the items are in the possession of our Drivers.
• Users must report any issues related to delivery within 48 hours of receiving their items.
4.2. Provider’s Liability
• Providers are responsible for the care and handling of laundry items once they are received.
• Any disputes regarding loss, damage, or misplacement of items must be resolved directly between the User and the Provider.
• Maghsala will assist in facilitating communication but cannot guarantee compensation or recovery.
4.3. User Responsibility
• Users are responsible for:
• Accurately listing items and quantities during order placement.
• Ensuring they are available at the designated location during pickup and delivery time windows.
• Promptly responding to Drivers and paying any due amounts.
5. Governing Law
These Terms are governed by the laws of Saudi Arabia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of Saudi Arabian courts.
